Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Analytics Command Center platform ("Platform") operated by WebFones Cloud LLC ("Company," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, signing in, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Description of Service
The Analytics Command Center is a web-based analytics dashboard that aggregates data from third-party services including Google Analytics 4, Google Search Console, Meta/Facebook, Instagram, and other sources. The Platform provides data visualization, reporting, AI-powered SEO recommendations, and first-party traffic analysis.
3. Account Registration and Access
- Access to the Platform requires authentication via Google OAuth.
- You must be authorized by an account administrator to access the Platform.
- You are responsible for maintaining the security of your Google account credentials.
- You must provide accurate and complete information when setting up your account.
- You must notify us immediately of any unauthorized access to your account.
4. Subscription Plans and Payment
The Platform is offered under the following subscription tiers:
- Starter: Up to 5 tracked sites
- Professional: Up to 15 tracked sites
- Agency: Up to 50 tracked sites
- Enterprise: Custom site limits and features
Subscription fees are billed monthly or annually as agreed upon at the time of purchase. A one-time setup fee may apply. All fees are non-refundable unless otherwise stated in a separate agreement.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the Platform or its infrastructure
- Interfere with or disrupt the Platform or its servers
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Share your account credentials or allow unauthorized users to access the Platform
- Use the Platform to collect, store, or process data in violation of any privacy laws
- Resell, sublicense, or redistribute access to the Platform without our written consent
- Use automated tools to scrape, crawl, or extract data from the Platform
6. Third-Party Services and Data
The Platform integrates with third-party services (Google, Meta, Anthropic) to retrieve and display your analytics data. You acknowledge that:
- Your use of these third-party services is governed by their respective terms of service and privacy policies
- We are not responsible for the availability, accuracy, or completeness of third-party data
- You are responsible for maintaining valid API credentials and permissions for connected services
- Changes to third-party APIs may affect Platform functionality
7. AI-Generated Content
The Platform includes AI-powered features that generate SEO recommendations and keyword strategies. You acknowledge that:
- AI-generated recommendations are suggestions only and should not be relied upon as professional SEO advice
- We do not guarantee the accuracy, completeness, or effectiveness of AI-generated content
- You are solely responsible for any actions taken based on AI recommendations
- AI features may be subject to usage limits based on your subscription tier
8. Data Ownership
You retain full ownership of your analytics data. We do not claim any ownership rights over data retrieved from your connected third-party services. We may use aggregated, anonymized data for platform improvement and benchmarking purposes.
9. Intellectual Property
The Platform, including its design, code, features, and documentation, is the intellectual property of WebFones Cloud LLC. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose during your active subscription.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance in advance.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBFONES CLOUD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE PLATFORM.
Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
13. Indemnification
You agree to indemnify and hold harmless WebFones Cloud LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
14. Termination
We may suspend or terminate your access to the Platform at any time for any reason, including violation of these Terms. You may cancel your subscription at any time. Upon termination, your right to use the Platform ceases immediately. We will retain your data for 30 days following termination, after which it will be permanently deleted.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of New Hampshire.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
